RTA, insurance liability, who is at fault. UK ONLY?

The fact that the driver didn't indicate and the biker was speeding are irrelevant. Overtaking is one of those "Don't do it unless you're sure it's safe to do so" jobs, so I'd say it was the biker's fault, especially if there are no witnesses to back up the allegation that the car driver didn't indicate.
